Charges To Be Filed In Killing Of NYC Subway Rider

The New York Daily News reports:

Daniel Penny, the Marine veteran whose chokehold killed Jordan Neely on a Manhattan subway train, is to be charged with second-degree manslaughter and will turn himself in to police on Friday, sources told the Daily News.

Penny, 24, is expected to turn himself in at the Fifth Precinct stationhouse on Elizabeth St. in Chinatown, said a police official. Manhattan DA’s office spokesman Doug Cohen confirmed the arrest charge.

Bystander video shows Penny holding Neely, 30, in a chokehold aboard an F train on May 1. He was taken in for questioning later that day, but was released without charges.

As many of you may know, the killing has spawned days of large protests demanding charges. The usual right wingers have loudly defended Penny as a folk hero. Neely, a onetime Michael Jackson impersonator, was homeless and suffered from mental illness. Witnesses say Neely had been shouting at passengers but had not interacted with Penny before the attack. At this writing, the cult is attacking Manhattan DA Alvin Bragg for the decision to file charges.
