Trump Lawyers Argue Free Speech In January 6 Case

In a flurry of court filings Monday night, former President Donald Trump argued the federal charges against him in Washington, D.C., are being brought by “biased prosecutors” and should be dismissed on various grounds.

In a series of four filings, Trump’s attorneys argued the charges against him should be dismissed on constitutional grounds including First Amendment protections, due to prosecutorial bias, and because “Trump did not violate the charged statutes, even accepting the prosecution’s false allegations as true.”

The motion to dismiss on constitutional grounds also cited Trump’s acquittal by the U.S. Senate in his second impeachment trial, arguing the D.C. indictment unconstitutionally charges him a second time with the same course of conduct.
