Nebraska Electoral College Change Blocked (For Now)

Nebraska legislators on Wednesday night blocked a late effort to change how the state allocates its Electoral College votes, despite public pressure from former President Donald Trump to shift to a winner-take-all system that would likely benefit him in the fall.

The measure fell short, 8-36, in a procedural vote. While it’s possible supporters could take another stab at advancing the proposal, there remain serious hurdles as the legislative session draws to a close, and it’s unclear whether the proposal has enough support to get across the finish line and become law.

State Sen. Loren Lippincott, who introduced the original winner-take-all bill, told the Nebraska Examiner that he’d make one final attempt to bring the measure up for a vote before the legislative session ends on April 18. However, it’s unclear whether there’s enough support for the change to move forward.

Trump, Nebraska Gov. Jim Pillen, and Nebraska legislative Republicans are encouraging the Nebraska legislature to pursue anti-democratic efforts that would make it easier for Trump to win all five of Nebraska’s electoral votes.

Nebraska is one of two states that awards one electoral vote to the Presidential candidate who wins each congressional district, but Republicans are working to subvert this already decided-upon allocation mid-election season to throw the election to Donald Trump.

The proposed change, introduced by Republicans in the legislature, would amend the process to become a winner-takes-all system that would almost certainly swing the election in Trump’s favor this fall.

Across the country, we’re seeing Republican efforts to subvert the will of voters and threaten our democracy. The state legislative ballot level is the most important for protecting democracy and voting rights and we need to elect more pro-democracy Democrats to state legislatures, like in Nebraska, which control the levers of power when it comes to how our elections are being run and electoral votes are being allocated.

President Joe Biden’s campaign officials have been in private talks with Nebraska Democrats after Republicans in the state began pushing for changes that could close off one of the president’s clearest paths to reelection.

Republican activists have targeted the law precisely because in recent cycles, including 2020, the Democratic presidential candidate won the Omaha-based 2nd District, giving them an additional Electoral College vote.

Conservative talk show host Charlie Kirk — who sparked a viral online pressure campaign in favor of LB 764 — is expected to appear in Omaha on Tuesday to rally for the bill’s passage. Kirk has encouraged his supporters to contact legislators to move it through committee.
